1. Introduction

Welcome to Electric Marine (the “Site”). The Site is operated by Momentum Electric Marine USA, Inc. (“we”, “us”, “our”). By accessing or using the Site, or placing an order through the Site, you (“you”, “Customer”, “User”) agree to be bound by these Terms and Conditions (“Terms”). If you do not agree with any part of these Terms, please do not use the Site.

2. Definitions

  • Products: means any electric outboard motors, jetboards, marine accessories, yacht toys or related items offered for sale on the Site.
  • Order: a request by you to purchase Products from the Site.
  • User Account: any account you create on the Site (if applicable).

3. Use of the Site & Acceptable Conduct

  • You agree to use the Site only for lawful purposes and in a way that does not infringe the rights of others.
  • You must not attempt to breach or circumvent any security or authentication measures on the Site.
  • We reserve the right to suspend or terminate access to the Site or your account if you violate these Terms.

4. Orders, Payment & Pricing

  • All orders placed by you are subject to our acceptance. We reserve the right to refuse or cancel any order at our sole discretion (for example, due to product unavailability, pricing error, suspected fraud, or other reasons).
  • The prices displayed on the Site are in USD and exclude any applicable taxes, duties, shipping or handling charges unless otherwise stated.
  • Payment must be made by the available payment methods at checkout. You represent and warrant that the payment information you provide is accurate, complete, and that you are authorized to use the payment method.

5. Product Information & Availability

  • We aim to display accurate product information (descriptions, specifications, pricing, availability) but do not guarantee that all information is completely up-to-date. We reserve the right to correct errors, change information, or modify / discontinue products without prior notice.
  • Colors, dimensions, specifications illustrated on the Site may vary slightly from the actual products due to screen differences or manufacturing tolerances.

6. Shipping, Delivery & Risk of Loss

  • Shipping costs, delivery times, and any applicable duties or customs fees will be specified at checkout or on the relevant shipping page.
  • Risk of loss and title for Products pass to you upon our delivery to the carrier (or other service provider). We are not responsible for delays or losses caused by the shipping carrier or for customs clearance if shipping internationally.

7. Returns, Refunds & Cancellations

  • Returns or refunds, if available, will be handled according to our separate “Refund and Returns Policy”. By placing an order you agree to that policy (linked at the footer of our Site).
  • We reserve the right to refuse returns or refunds if the Product has been used, altered, or damaged by you, or if return is requested after the time window specified in the Returns Policy.

8. Intellectual Property

  • All content on the Site — including but not limited to text, images, logos, designs, trademarks, product photos — is owned or licensed by us and is protected under applicable intellectual property laws.
  • You may view and download content only for your personal, non-commercial use. Any other use (copying, reproduction, distribution, modification, publication) without our prior written consent is prohibited.

10. Limitation of Liability & Disclaimer of Warranties

  • To the fullest extent allowed by law, we disclaim all warranties, whether express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement.
  • We will not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data loss, or personal injury arising from your use of the Site or Products — even if we have been advised of the possibility of such damages.
  • Our total liability to you for any claim arising out of or in connection with these Terms or your order is limited to the amount you paid us for the relevant Product(s).

11. Customer Account, Registration & Security (if applicable)

  • If you create a User Account, you agree to provide accurate, complete and up-to-date registration information and to maintain the confidentiality of your account credentials.
  • You are solely responsible for all activities that occur under your account. You must notify us immediately of any unauthorized use or security breach of your account.
  • We reserve the right to suspend or terminate accounts that violate these Terms, with or without notice.

  • We may modify these Terms at any time (for example, to reflect changes in law, business practices or service offerings). When we do, we will update the “Effective Date” at the top of this page.
  • By continuing to use the Site after the updated Terms are posted, you accept and agree to the new Terms.

13. Governing Law & Jurisdiction

  • These Terms, and any dispute arising out of or related to them, shall be governed by the laws of State of California, USA.
  • You agree that any dispute will be brought exclusively in the courts of State of California, USA.

14. Severability

If any part of these Terms is found to be invalid or unenforceable by a court, that part will be limited or removed to the minimum extent necessary so that the remainder of the Terms continue in full force and effect.
