Affiliate Program Terms and Conditions

These Terms and Conditions (“Agreement”) govern your participation in the Electric-Marine.com Affiliate Program (“Program”) operated by Momentum Electric Marine USA Inc. (“Company”, “we”, “us”, or “our”). By signing up and participating, you (“Affiliate”, “you”) agree to comply with this Agreement.

1. Program Enrollment

To enroll, complete the affiliate application via our platform on www.electric-marine.com. We reserve the right to accept or reject any application at our sole discretion.

2. Your Responsibilities

As an approved Affiliate, you agree to:

  • Only use promotional content and links provided or approved by us.
  • Represent our brand truthfully and ethically.
  • Clearly disclose your affiliate relationship (e.g., “I may earn commissions from qualifying purchases”).
  • Avoid spamming or deceptive advertising practices.
  • Comply with all applicable laws and regulations, including the FTC’s endorsement guidelines.

3. Prohibited Channels and Content

You may not promote Electric-Marine products on websites or social channels that:

  • Contain hate speech, adult content, or illegal activities.
  • Engage in click fraud, cookie stuffing, or misleading redirects.
  • Include unapproved coupon/discount websites.
  • Infringe on intellectual property or violate third-party rights.

4. Affiliate Links & Tracking

Each Affiliate is assigned a unique tracking URL. You are responsible for ensuring it is used correctly. We are not liable for lost commissions due to improper link usage, disabled cookies, or technical failures outside our control.

5. Commission Structure

  • Commission rates are defined within your affiliate dashboard.
  • Commissions apply only to completed purchases made through your referral link.
  • Orders cancelled or refunded will not qualify for commission.
  • Commissions are calculated on the net sale value (excluding tax, shipping, and discounts).

6. Minimum Payout & Payment Schedule

  • Commissions are paid out monthly via [insert method, e.g. PayPal or bank transfer].
  • Minimum payout threshold is $50 USD.
  • Earnings below $50 will roll over to the following month until the threshold is met.
  • Affiliates are responsible for ensuring their payment and tax information is accurate and up-to-date.

7. Returns, Refunds & Chargebacks

If a referred customer’s order is refunded or charged back, the related commission will be reversed from your balance. If already paid, it will be deducted from future earnings.

8. Term & Termination

  • This Agreement is effective upon your acceptance and continues until terminated.
  • We reserve the right to suspend or terminate your account at any time for violation of this Agreement, suspected fraud, or harmful behavior.
  • You may terminate your participation at any time by notifying us in writing.

9. Relationship

You are an independent contractor. Nothing in this Agreement creates a joint venture, partnership, or employment relationship.

10. Liability Limitation

We are not responsible for indirect or consequential damages. Our total liability for any claim related to the Program will not exceed the total commissions paid to you in the past 12 months.

11. Governing Law

This Agreement is governed by the laws of the State of Florida, USA.

12. Changes to the Program

We may modify this Agreement or the terms of the Program at any time. Continued participation constitutes acceptance of the revised terms. Affiliates will be notified of any material changes.
